Terms of Service

1. Acceptance of terms

By creating an account or using DMZap (“the Service”), you agree to be bound by these Terms. If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and [Your Company Name] (“DMZap”, “we”, “us”).

2. The service

DMZap provides Instagram DM automation software that enables businesses and creators to automatically reply to Instagram comments via direct message, using Meta's official Instagram Graph API. The Service is provided on a subscription basis.

3. Eligibility

• You must be at least 18 years old to use the Service.
• You must have a valid Instagram Business or Creator account.
• You must comply with Meta's Terms of Service and Community Guidelines.
• The Service is intended for business and professional use.

4. Acceptable use

You agree not to use DMZap to:

• Send spam, unsolicited messages, or harassing DMs
• Violate Meta's Platform Policies or Instagram Community Guidelines
• Impersonate other people or organisations
• Automate interactions that violate Instagram's rate limits
• Send illegal, defamatory, or harmful content
• Circumvent or attempt to circumvent any security features
• Resell or sublicense the Service without written permission (Agency plan holders excluded)

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Subscription and billing

• Subscriptions are billed monthly or annually in advance via Razorpay.
• The 14-day free trial applies to new accounts only. No credit card is required to start.
• After the trial, you will be charged the applicable plan rate unless you downgrade to Starter (free) before the trial ends.
• All prices are in Indian Rupees (INR) and inclusive of applicable taxes.
• Refunds are available within 7 days of initial payment. No refunds after 7 days.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.

6. Instagram API and Meta compliance

DMZap operates as a Meta Business Partner using the official Instagram Graph API. Your use of DMZap is subject to Meta's Terms of Service. We make no guarantees regarding the continued availability of Instagram API features, as Meta may change or restrict API access at any time.

You are responsible for ensuring that your use of DMZap — including the content of your DM templates and trigger keywords — complies with Instagram's policies.

7. Data and lead ownership

All lead data captured through your automations belongs to you. DMZap acts as a data processor on your behalf. We do not use your lead data for our own marketing or share it with third parties. See our Privacy Policy for full details.

8. Intellectual property

The DMZap platform, logo, and all associated software are owned by us and protected by copyright. You may not copy, modify, distribute, or create derivative works without written permission.

You retain ownership of all content you create — DM templates, brochures, and other materials — and grant us a limited licence to process them solely to deliver the Service.

9. Limitation of liability

To the fullest extent permitted by law, DMZap shall not be liable for:

• Loss of revenue, leads, or business opportunities
• Instagram account restrictions or bans resulting from your use of the Service
• Interruptions to the Service due to Meta API downtime or policy changes
• Any indirect, incidental, or consequential damages

Our total liability to you shall not exceed the amount you paid us in the 3 months preceding the claim.

10. Termination

You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period — you retain access until then.

We may terminate your account immediately if you breach these Terms, with or without notice.

11. Governing law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of [Your City], India.
